A lawsuit was filed against Luxury Haus Inc., in the Superior Court of New Jersey, Hudson County, Jersey City, New Jersey.
The case was brought under the Consumer Fraud Act and the Motor Vehicle Sales Practices seeking recovery of ascertainable loss, reasonable attorney’s fees and costs arising out of the purchase of an automobile from the defendant, Luxury Haus.
According to our client, as set forth in the lawsuit, she was 21 years old when she went to Luxury Haus to purchase a used 2012 Jeep Wrangler for $29,000. Luxury Haus represented that the vehicle was in excellent condition, but one month later, the roof started to leak and water was seeping into the engine. Luxury convinced her to purchase a service contract warranty for $3500 and promised that if anything goes wrong with the vehicle, she can simply bring it back to Luxury and they will have it fixed. However, when the plaintiff called Luxury, they, for the first time, told her that she was covered under the manufacturer’s warranty and that she should take the vehicle to the Jeep dealer.
The suit alleged that Luxury committed an unconscionable commercial practice and misrepresentation in failing to advise our client that she was covered under the vehicle’s manufacturer’s warranty in order to sell her a service contract, which they never intended to honor.
Luxury Haus also charged our client $1295 for “Processing for IAFLP” without advising or explaining to her what those charges were, and in violation of the New Jersey Motor Vehicle Sales Practices.
Luxury Haus also charged our client $399 for ““Doc Fee,” without providing an itemization of the actual charges, in violation of the New Jersey Motor Vehicle Sales Practices, which makes it an unlawful act for an automobile dealer to charge a fee for documentary service without itemizing each service performed.
Luxury Haus also charged our client $199 for title and registration without providing an itemization of the actual charges, in violation of the New Jersey Motor Vehicle Sales Practices, which makes it an unlawful act for an automobile dealer to charge a fee for documentary service without itemizing each service performed. Further, the fees to register and title a vehicle in the State of New Jersey are less than $199.
